Information regarding the Inquiry into The Uckfield Appeals

The Inquiry has now finished sitting

18th July 2008

The Inquiry commenced at 9.30 am. Planning Obligations for Bird-in-Eye South and Downlands were covered followed by Conditions by all parties.

The following timetable was agreed:-

1st August - completion and exchange of Planning Obligations by was agreed.

5th September - All parties to comment on Housing Land Supply in light of the South East Plan

12th September - Wealden District Council closing submissions

19th September - Appellants closing submissions

26th September - Any cost applications to be submitted

3rd October - Responses to submissions

10th October - Final reply to responses

The sitting session of the Inquiry ended at 1.20 pm

17th July 2008

The Inquiry commenced at 9.30 am. Mr Woolf (on behalf of Woolf Bond Planning in connection with Land at Bird in Eye North) gave his Evidence in Chief in relation to Planning Policy, followed by cross examination by other parties. Mr Tustain (on behalf of Broadway Malyan in connection with Downlands) gave his Evidence in Chief, followed by cross examination by other parties.

Planning Obligations for Bird-in-Eye North were also covered during the day.

16th July 2008

The Inquiry commenced at 9.30 am. Third party representations were heard from 5 members of the public. This was followed by the continuation of cross-examination of Mr Walker (on behalf of Wealden District Council) by Mr Village (on behalf of Woolf Bond Planning in connection with Land at Bird in Eye North), Mr Dove (on behalf of Boyer Planning in connection with Land at Bird in Eye South) and Mr Clay (on behalf of Broadway Malyan in connection with Downlands). Re-examination of Mr Walker by Mr Boyle then took place.

15th July 2008

The Inquiry commenced at 9.30 am. Cross-examination continued of Mr Brown (on behalf of Broadway Malyan in connection with Downlands) by Mr Boyle (on behalf of Wealden District Council). This was then followed by re-examination of Mr Brown by Mr Clay (on behalf of Broadway Malyan in connection with Downlands) and questions from the Inspector. The Highways topic was completed.

Mr Walker's Evidence in Chief regarding Planning Policy was conducted by Mr Boyle (on behalf of Wealden District Council), followed by commencement of cross-examination by Mr Village (on behalf of Woolf Bond Planning in connection with Land at Bird in Eye North) regarding Noise issues in relation to Planning Policy.

11th July 2008

The Inquiry commenced at 9.30 am. Cross-examination commenced of Mr Brown (on behalf of Broadway Malyan in connection with Downlands) by Mr Boyle (on behalf of Wealden District Council). This cross-examination is due to be completed on Tuesday 15th July. Cross-examination by Mr White (on behalf of Woolf Bond Planning in connection with Land at Bird in Eye North) took place.

10th July 2008

Cross-examination took place of Mr Russell by Mr Clay (on behalf of Broadway Malyan in connection with Downlands), followed by re-examination by Mr White of Mr Russell and questions from the Inspector. This was followed by Mr Brown's Evidence in Chief by Mr Clay (on behalf of Broadway Malyan in connection with Downlands).

9th July 2008

Mr Clay's (on behalf of Broadway Malyan in connection with Downlands) cross-examination of Mr Harris (on behalf of Wealden District Council) was completed in the morning. Re-examination by Mr Boyle (on behalf of Wealden District Council) then took place of Mr Harris, followed by questions from the Inspector to Mr Harris. Mr White's Examination in Chief of Mr Russell (on behalf of Woolf Bond Planning in connection with Land at Bird in Eye North).

8th July 2008

Mr Clay (on behalf of Broadway Malyan in connection with Downlands) cross examined Mr Harris (on behalf of Wealden District Council). This will continue tomorrow for 1.5 to 2 hours, after which Evidence in Chief by Mr Russell (on behalf of Woolf Bond Planning in connection with Bird-in-Eye North) on Highways, followed by cross exanimation by Mr Clay.

3rd July 2008

The Highways topic commenced with Evidence in Chief by Mr Boyle of Mr Harris (on behalf of Wealden District Council). Cross-examination of Mr Harris will be undertaken on Tuesday, 8th July by Mr Clay (on behalf of Broadway Malyan in connection with Downlands).

2nd July 2008

The Ecology topic continued. Mr Dove Q.C. (on behalf of Boyer Planning in connection with Land at Bird in Eye South) continued and completed his cross-examination of Mr Colebourn (on behalf of Broadway Malyan in connection with Downlands). This was followed by cross-examination by Mr White (on behalf of Woolf Bond Planning in connection with Land at Bird in Eye North) of Mr Colebourn. Mr Clay (on behalf of Broadway Malyan in connection with Downlands) then undertook re-examination of Mr Colebourn, followed by questions from the Inspector to Mr Colebourn. This completed the Ecology topic.

1st July 2008

Continuation of the Ecology topic. Mr Boyle (on behalf of Wealden District Council) commenced his cross-examination of Mr Colebourn (on behalf of Broadway Malyan in connection with Downlands). This was followed by the cross-examination of Mr Colebourn by Mr Dove Q.C. (on behalf of Boyer Planning in connection with Land at Bird in Eye South).

19th June 2008

Evidence in Chief of Mr Colebourn by Mr Clay (on behalf of Broadway Malyan in connection with Downlands) took place until mid-afternoon. No cross-examination of Mr Colebourn took place. The Inquiry then adjourned until 10am on 1st July when it is anticipated that the Ecology topic will be completed.

18th June 2008

Mr Clay (on behalf of Broadway Malyan in connection with Downlands) continued his cross-examination of Mr Meurer (on behalf of Boyer Planning in connection with Land at Bird in Eye South), which was the followed by re-examination of Mr Meurer by Mr Dove QC (on behalf of Boyer Planning in connection with Land at Bird in Eye South). Questions were then put to Mr Meurer by the Planning Inspector.

This was followed by Evidence in Chief of Ms Farr (Case Officer for the Woodland Trust) by Mr Walton (on behalf of the Woodland Trust) regarding Downlands, followed by cross-examination of Miss Farr by Mr Clay (on behalf of Broadway Malyan in connection with Downlands). Questions were then put to Ms Farr by the Planning Inspector.

17th June 2008

The Inquiry re-convened with the Ecology topic.

Dr Stephanie Wray (on behalf of Woolf Bond Planning in connection with Land at Bird in Eye North) completed her Evidence in Chief, this was then followed by cross-examination of Dr Wray by Mr Clay (on behalf of Broadway Malyan in connection with Downlands) and a further short re-examination by Mr White. Questions were then put to Dr Wray by the Planning Inspector.

Mr Meurer (on behalf of Boyer Planning in connection with Land at Bird in Eye South) gave his Evidence in Chief. Mr Clay (on behalf of Broadway Malyan in connection with Downlands) commenced his cross-examination of Mr Meurer.
