Industrial or commercial noise

Noise from industrial or commercial premises is varied and can be very intrusive if measures are not in place to control and limit the effect of the noise.

Industrial or commercial noise can be a particular issue when it occurs during the evening, during parts of the weekend, during Bank Holidays, Public Holidays and at night.

Although it is important to have a vibrant night time economy, this can have an impact on people that live within the vicinity of these businesses. Licensed premises such as pubs, clubs and restaurants can, under certain circumstances, be the source of noise and if insufficient controls are in place music and people noise can cause disturbance.

As well as the noise from the main activity of the business, the noise from associated air conditioning or air handling units and other mechanical plant can also have a negative affect on those that are within close vicinity.

We are able to take action if it is possible to prove that the noise is causing a Statutory Nuisance. It is a defence however to prove that best practicable means are being used to prevent the effects of the nuisance.

Fireworks

Fireworks can be a noise problem for people and pets. They are let off not only for traditional celebrations such as Bonfire Night and New Year but also year round to mark public and private celebrations.

The Fireworks Regulations 2004 prohibit anyone under 18 from possessing display fireworks. They also prohibit the use of fireworks between 11pm and 7am except for Chinese New Year, Diwali, New Years Eve and 5th November. Since 2005 only licensed traders can supply fireworks all year round. Unlicensed traders can only sell them for short periods around the festivals mentioned

Loudspeakers

The use of loud speakers in the streets is banned between 9pm and 8am, the police, ambulance and fire brigade are exempt.

Vehicles selling perishable foods may also use loud speakers between 12 noon and 7pm and these times can be varied by consent.
