Neighbourhood Planning

The Localism Act (2011) provides a local tier to the planning system called Neighbourhood Planning. This allows local communities the option of producing a Neighbourhood Development Plan, a Neighbourhood Development Order, or a Community Right to Build Order for their area.

It provides communities with a more direct means of shaping development in their local areas. Neighbourhood planning provides communities with the opportunity to produce plans for their local area called Neighbourhood Development Plans which are statutory (legally prescribed) and when adopted form part of the development plan for the area.

The Neighbourhood Planning (General) Regulations 2012 (external link) designate Parish or Town Councils as the responsible body for neighbourhood planning in parishes in Wealden District.

If you or your community are interested in neighbourhood planning we recommend that you initially contact your Parish Council to discuss and develop ideas on how it is being used or how it could be used in your area.

Guidance on Neighbourhood Planning

In June 2012 we provided all of the Parish and Town Councils in Wealden with;

In April 2013 the Department of Environment, Food and Rural Affairs (Defra) produced a report on a series of case studies, with particular focus on rural front runners, for communities considering neighbourhood planning to consider as they develop their own neighbourhood plans and development orders.

This guide draws upon Locality experience of working with community groups that are considering or undertaking Neighbourhood Planning. Whilst other guides are predominantly concerned with the legislation and process, locality have included guidance on good practice and worksheets for carrying out each part of the plan.

Herstmonceux Neighbourhood Plan

Wealden District Council is publishing the submitted Herstmonceux Parish Neighbourhood Plan for consultation. The consultation will run from 25th September 2017 until 6th November 2017.

Wealden District and the South Downs National Park

Wealden District has two Planning Authorities covering its geographic area: Wealden District Council and the South Downs National Park Authority. The South Downs National Park Authority (SDNPA) and Wealden District Council have agreed to the principle of signing up to a joint protocol on neighbourhood planning. This will clarify who is the lead authority in terms of providing advice and support, and who is responsible for arranging any referenda, and the examination requirements.
