Wealden District Council are carrying out a public consultation on the Councils Planning Validation Guide. The document is a guide to submitting applications and includes the National and Local Validation Lists.
What is the local validation list?
The local validation list sets out the information that we require to be able to register, assess and determine planning applications. The amount of information required will vary depending on the type, scale and location of the proposed development including any site specific constraints. Not all the local information requirements will apply to every planning application. We will only ask for what is required to determine the planning application.
Consultation on Local Validation List
Since 2008 local planning authorities have been required to publish a list of information they require to “validate” the planning applications they receive. This validation list forms two components, the national requirements, including the application form, the fee, certificates etc and secondly, specific local validation requirements known as the “Local List”.
The Government requires local planning authorities to review the “local list” every two years. In addition, there continue to be a significant number of changes to planning legislation, policy and guidance. It is therefore considered timely to review our current validation requirements.
What are the changes?
The format of the document has changed in the hope to make the document more user friendly. The changes also ensure that reference is made to current legislation, guidance and standing advice.
The Consultation Process
The Council is seeking your views on the content of the revised validation list. The consultation period will run from 9th November 2020 until midnight on 4th January 2021.
If you disagree with any of the content, it would be useful if you could explain why you disagree and provide evidence (case law/appeal decisions) if you feel the content is disproportionate.
How to make your comments
The easiest way to comment on the document is through our planning consultation portal. However you may also comment upon the draft list by email to WDCTechnicalteam@wealden.gov.uk or put your comments in writing to Planning, Wealden District Council, Vicarage Lane, Hailsham, East Sussex, BN27 2AX.
It will not be possible to respond directly to the comments received. After the consultation period, we will consider all the comments received and amend the Local List as appropriate. Once approved this will replace the current Local List and will form the basis on which planning applications are deemed valid by Wealden District Council.
