Suggest a Tree Preservation Order

Trees make a huge difference to the character of our towns, villages, and countryside. They provide shade, shelter, and homes for wildlife, as well as helping to make our communities more attractive.

If you know of a tree (or group of trees) that you think requires protection, you can suggest that we place a Tree Preservation Order (TPO) on it.

A TPO is a legal safeguard that prevents important trees from being cut down, pruned, or damaged without the Council’s consent. Protecting these trees ensures they continue to benefit both residents and the local environment.

 We normally issue a TPO if a tree:

  • may be at risk of being felled or damaged
  • is visually significant and can be seen from a public place
  • contributes positively to the look and feel of the local area

You must apply for permission from the Council before carrying out works such as pruning, lopping, or felling

Unauthorised works are a criminal offence and can result in a fine of up to £20,000

If you believe a tree in Wealden should be protected, please complete our online form We will require some details such as:

  • where the tree is located
  • why you think it should be protected
  • who owns the tree (if known)

The Council will consider each suggestion on a case-by-case basis and not every tree suggested will be made the subject of a TPO. This is because a TPO can only be made where a tree makes a significant contribution to public amenity and where it is expedient to protect it.

Trees that are healthy but tucked away in back gardens, or those that do not add to the wider landscape, may not meet the criteria.

There is no right of appeal against the Council’s decision not to make a TPO.
