For a representation to be deemed “relevant” it must reference one or more of the four licensing objectives (crime & disorder, public safety, public nuisance, protection of children from harm). Detail your concerns about why you are against the grant of a licence under the relevant licensing objective heading(s), ideally with supporting evidence and not conjecture.
The following matters are not ‘relevant’ to premises licence applications:
- the need for the premises;
- alternative premises are nearby;
- demand for the premises;
- increase in traffic;
- inadequate provision for car parking;
- access e.g. single lane country lane;
- effect on house prices;
- lack of planning permission; planning restrictions.
We cannot accept representations that we deem to be ‘frivolous’ or ‘vexatious’. A ‘frivolous’ representation is one that is lacking in seriousness; a ‘vexatious’ representation is made purely to cause annoyance to the applicant.
Representations in ‘support’ of the application must also reference one or more of four licensing objectives (crime & disorder, public safety, public nuisance, protection of children from harm).
You must provide your full postal address otherwise we will not accept your representation (and for contact purposes, an email address and telephone number).
The applicant will receive a copy of your representation (email addresses and telephone numbers are redacted). The applicant may contact you in an attempt to find a reasonable compromise.
Relevant representations must be submitted in writing and can be posted to:
Head of Environmental Health, Wealden District Council Licensing Team, Town Hall, London Road, Bexhill on Sea, East Sussex, TN39 3JX
Or via e-mail to licensing@rother.gov.uk (representations by email are preferred because we can communicate more easily with you).
Representations must be received by the “last day” date shown. Please mark the letter or e-mail “Representation” quoting the premises address and application reference number.
All relevant representations will be published in a public report. A hearing will be held (within approximately 20 working days from the last date for representations) to determine the application. You will be invited to attend and address councillors in person about your concerns/support. The applicant can also ask you questions about your representation. Please note that the hearing will be televised to the public via the Council’s website.
It is an offence to knowingly or recklessly make a false statement in a representation (the maximum fine on summary conviction being unlimited).
