Club Premises Certificate Redress and Complaints

Certificate Holder Redress

A Club Premises Certificate Holder may appeal against any decision of the Licensing Authority to:

  • Reject an application for the grant of a Club Premises Certificate
  • Impose conditions on the grant of a Club Premises Certificate
  • Reject (in whole or in part)  an application to vary a Club Premises Certificate
  • Modify the conditions of an existing Club Premises Certificate
  • Modify conditions, exclude qualifying club activity, to suspend a Club Premises Certificate  or to revoke a Club Premises Certificate  following an application for Review
  • withdraw the Club Premises Certificate where the Licensing Authority considers that the club is no longer a qualifying club

All appeals must be made to the local Magistrates’ court within 21 days of notice of the Licensing Authority’s decision.

Interested Party, Club Member or Responsible Authority Redress

Where problems associated with the operation of a premises and its failure to meet the licensing objectives then application may be made by Interested Parties, as defined under the Act, a member of the club, or Responsible Authorities for a Review of the Club Premises Certificate. If the application is deemed relevant in Licensing Act terms then the Licensing Authority will hold a Hearing to determine the application.
Similar rights of appeal exist for Interested Parties a club member party to any proceedings, or any of the Responsible Authorities against any decision of the Licensing Authority as for the Club Premises Certificate Holder (see above).

Consumer Complaint
